General Terms and Conditions
For the booking and implementation of package tours between Juulchin World GmbH, hereinafter ‘Juulchin Tours Mongolia’, and the booking party, the ‘traveler’, the following General Terms & Conditions apply, provided that nothing else has been agreed.
GENERAL TERMS AND CONDITIONS (GTC) for tour bookings via www.juulchin.com
For the business relations between Juulchin World GmbH vand the purchaser of services via the online sales platform at www.juulchin.com as well as for all other types of services, the following general terms and conditions (GTC) apply in their version at the date of the booking. By using www.juulchin.com or acquiring tour related services via firstname.lastname@example.org, you agree to these terms and conditions. Please read the terms carefully before finalizing the prepayment and/or payment of services
1. Registration, booking confirmation
By registering, the customer makes an offer to Juulchin World GmbH to enter into a travel contract. Upon acceptance, which requires no particular form, the contract is also binding upon Juulchin World GmbH. When the contract is entered into, or immediately thereafter, Juulchin Tours Mongolia UG shall give the customer a written booking confirmation via e-mail. If there is any variation between what is stated in the booking confirmation and the customer’s registration form, this shall be expressly referred to in the booking confirmation. Juulchin World GmbH is bound by this new offer for 10 days. The contract comes into effect on the basis of this new offer if the customer declares his/her acceptance of it within 10 days.
2. Payment, dispatch of travel documents
2.1. Juulchin World GmbH is permitted to take payments towards the travel price prior to the end of the trip only against delivery of a risk coverage certificate within the meaning of section 651 k para. 3 of the German Civil Code (Bürgerliches Gesetzbuch). This applies also in respect of deposits.
2.2. After receipt by the customer of the booking confirmation and the invoice, a deposit is due: Deposit amounts may vary dependant on the tour and cabin type. The deposit amounts are indicated for each tour in the pricing section, but may be subject to change. The full balance must be received by Juulchin World GmbH 60 days prior to commencement of the trip. Payments must be made to Juulchin World GmbH to be effective in discharging the debt. The trip is accordingly only paid for in full when the agreed travel price has been credited to the account of Juulchin World GmbH.
2.3. If you pay by credit card, your account will be debited automatically on the respective dates.
2.4. If you do not make the down payment and / or the final payment according to the agreed payment due dates, although we are ready and able to properly provide the contractual services, have fulfilled our statutory information obligations and there is no legal or contractual right of retention in your favor, then we are entitled to withdraw from the travel contract after a reminder with a deadline and to charge you with withdrawal costs in accordance with section 4.2, sentences 2 to 4.5.
3. Changes to services & price before the start of the tour
3.1 Deviations in essential characteristics of travel services from the agreed content of the travel contract, which become necessary after the conclusion of the contract and which we have not brought about in good faith on our part, are permitted to us before the start of the journey, provided that the deviations are insignificant and do not affect the overall design of the trip.
3.2 Juulchin Tours Mongolia is to inform the booking party about changes in service immediately after becoming aware of the need to the change on a permanent data carrier (e.g., also by e-mail, SMS or voice message) in a clear, understandable and highlighted manner.
3.3 In the event of a significant change in an essential characteristic of a travel service or a deviation from your special requirements that have become part of the travel contract, you are entitled to a reasonable period set by us at the same time as notification of the change
- either accept the change
- or withdraw from the travel contract free of charge
- or to request participation in a replacement trip if we have offered such a trip.
You have the choice whether to respond to our communication or not. If there is no or no timely response to us, the notified change is deemed accepted. We point this out to you in the declaration in accordance with section 3.2. Otherwise, you can either agree to the change in the contract, request participation in a replacement trip, if one has been offered to you, or withdraw from the contract free of charge.
3.4 Any warranty claims remain unaffected insofar as the changed services are defective. If we had lower costs for the implementation of the changed trip or replacement trip with the same quality, you must be reimbursed the difference in accordance with Section 651m (2) BGB.
4. Cancellation by the customer before the start of the journey/cancellation costs
4.1 The customer can withdraw from a confirmed trip up until commencement of the trip. If the customer withdraws from the trip or if he/she does not embark upon the trip he/she must pay Juulchin World GmbH an amount in compensation. The level of compensation is calculated in accordance with the agreed travel price, from which are to be deducted savings in expenses and savings which Juulchin World GmbH makes from third party use of the travel services.
4.2 In the event of withdrawal before the start of the journey or if the journey does not start, we lose the right to the travel price. Instead, we can demand appropriate compensation if we are not responsible for the withdrawal or if exceptional circumstances occur at the destination or in its immediate vicinity that significantly impair the execution of the trip or the transport; if inevitably extraordinary circumstances occur when they are not under our control and their consequences could not have been avoided even if all reasonable precautions had been taken.
4.3 Juulchin World GmbH is entitled to express the compensation claim as a flat rate amount as follows. The amount of compensation is calculated based on the travel price. The value of the expenses saved by the tour operator as well as the payments that are acquired through other use of the travel services are deducted.
Cancellation Conditions for All Journeys
• Up to 91 days prior to departure: 15% of total price
• Between 90 and 41days prior to departure: 45% of total price
• Between 40 and 11 days prior to departure: 80% of total price
• 10 or fewer days prior to departure or no-show: 100% of total price
4.4 We have set a flat rate for the amount of compensation taking into account the period between the declaration of withdrawal and the start of the journey as well as taking into account the expected savings in expenses and the expected acquisition through other uses of the travel services. At your request, Juulchin Tours Mongolia is obliged to justify the amount of the compensation. Please refer to section 13 of these travel conditions below for the compensation lump sums.
4.5 In any case, you are entitled to prove that the reasonable compensation to which we are entitled is significantly lower than the required flat-rate compensation.
If we are obliged to reimburse the travel price as a result of a withdrawal, we shall pay within 14 days of receipt of the declaration of withdrawal.
4.6 Juulchin Tours Mongolia cannot claim any compensation if unavoidable, extraordinary circumstances occur at or in the immediate vicinity that significantly affect the implementation of the package tour or the transport of people to the destination. Circumstances are unavoidable and extraordinary in the sense of this subtitle if they are not subject to the control of the party who invokes them and their consequences could not have been avoided even if all reasonable precautions had been taken. In these cases, both Juulchin Tours Mongolia and the traveler are entitled to withdraw. Juulchin Tours Mongolia will make payments on the tour price within 14 days of the cancellation.
5. Rebooking/substitute participants
5.1 After the conclusion of the contract, there is no entitlement to changes to the trip, in particular with regard to the travel date, the travel destination, the place of departure, the accommodation or the type of transport (rebooking). In the event of an agreement on a change in the booking, the traveler must assume the additional costs that arise as a result. These will be given to you when you change your booking. The above regulations do not apply if the rebooking is necessary because we did not provide you with insufficient or incorrect pre-contractual information in accordance with Art. 250 § 3 EGBGB; in this case the rebooking is free of charge.
5.2 Your statutory right, in accordance with Section 651e of the German Civil Code (BGB), to require us to notify you on a permanent data carrier that a third party takes over the rights and obligations from the travel contract instead of you, remains unaffected by the above conditions. Such a declaration is in any case timely if we receive it 7 days before the start of the journey.
6. Unused service
If you do not make use of individual travel services that we were willing and able to provide in accordance with the contract for reasons that are attributable to you, you are not entitled to a proportionate reimbursement of the travel price. This does not apply if such reasons would have entitled you to withdraw from the contract free of charge or to terminate the travel contract according to the statutory provisions. We will endeavor to obtain reimbursement of the saved expenses by the service providers. This obligation does not apply if the expenses involved are completely insignificant.
7. Termination for behavioral reasons
Juulchin Tours Mongolia can withdraw from the travel contract or terminate the travel contract without notice after the start of the journey if the traveler disrupts the implementation of the journey, regardless of our warning, or behaves contrary to the contract to such an extent that immediate cancellation of the contract is justified. This does not apply if the behavior contrary to the contract is caused by a violation of our own information obligations. If Juulchin Tours Mongolia terminates, we retain the right to the travel price; however, we must offset the value of the saved expenses as well as those advantages that we obtain from other use of the unused services, including any amounts reimbursed to us by the service providers.
8. The traveler's duty to cooperate
8.1 Travel documents
Please inform us or the travel agent through whom you have booked the travel services in good time if you have not received the required travel documents within the specified deadline.
8.2 Notification of defects / request for remedy
If the trip is not provided free of travel defects, the traveler can request remedial action from our local representative or, alternatively, from Juulchin Tours Mongolia. This requires - irrespective of our overriding performance obligation - your cooperation. You are therefore obliged to do everything reasonable to help rectify the fault and to keep any damage as low as possible or to avoid it entirely. Insofar as Juulchin Tours Mongolia could not remedy the situation due to a culpable failure of the traveler to report the defect, the traveler is not entitled to a reduction in price according to § 651m BGB nor claims for damages according to § 651n BGB.
8.3 Deadline before termination
For this reason, the travel contract can only be terminated due to a significant travel deficiency of the type described in § 651i Paragraph 2 BGB if the traveler has previously set a reasonable period for remedial action. This does not apply only if Juulchin Tours Mongolia refuses to provide a remedy or if an immediate remedy is necessary.
9. Limitation of Liability
9.1 The contractual liability of Juulchin Tours Mongolia for damage that is not physical damage and was not culpably caused is limited to three times the travel price.
9.2 The tortious liability of Juulchin Tours Mongolia for damages that are not physical or sexual self-determination and were not culpably caused is limited to three times the travel price.
9.3 Claims based on international agreements or statutory provisions based on such agreements that go beyond the damage mentioned in the two preceding paragraphs remain unaffected by the restrictions.
9.4 Juulchin Tours Mongolia is not liable for service disruptions, personal injury or property damage in connection with travel services that are only brokered as third-party services (e.g. arranged excursions, sporting events, theater visits, exhibitions) if these services are expressly stated in the travel advertisement and the travel confirmation stating the identity and address of the mediated contract partner are clearly marked as external services so that they are not recognizable to you as part of our travel services and have been selected separately. Sections 651b, 651c, 651w and 651y BGB remain unaffected. However, we are liable if and to the extent that your damage was caused by a breach of duty to inform and/or to organize.
10. Assertion of claims: address, information on consumer dispute resolution
10.1 You have to assert claims for defects against Juulchin Tours Mongolia. The assertion can also be made through the travel agent if the travel services were booked through this travel agent. An assertion on a permanent data carrier is recommended.
10.2 We would like to point out that we do not participate in voluntary consumer dispute resolution. We refer to the European online dispute resolution platform http://ec.europa.eu/consumers/odr for all travel contracts that were concluded in electronic legal transactions.
11. Travel protection (travel cancellation insurance, etc.)
We would like to point out that in some cases of withdrawal (e.g. unexpected illness before departure) you can take out cancellation insurance and travel interruption insurance. We also strongly recommend that you acquire insurance to cover the costs of assistance including repatriation in the event of an accident, illness or death.
12. Data protection
When you book, we collect personal data that is necessary for the fulfillment and execution of the travel contract. These data are electronically stored, processed and - if necessary for the purpose of the contract - transmitted to third parties, e.g. service providers such as hotels and airlines.
13. Compensation lump sums (see sections 4.2 and 4.3)
The respective amount of the compensation fee depends on the selected travel service and the time of receipt of your declaration of cancellation by us. If you have put together several travel services with individual prices (e.g. flight and round trip), the compensation must be determined individually using the flat rates shown below and then added up. Please note any deviations that may have priority in the tenders for the individual travel services.
